The Tyranny of our Ever Expanding Government

“Law is defined to be a rule of action; but how can that be a rule, which is little known and less fixed?” — James Madison, Federalist No. 62 — 1788

When writing about the tyranny of a mutable government and the legislature passing long and complicated laws of which no one could comprehend and obey James Madison raises the very forceful point. He stated that citizens will find it very difficult to obey the law if it is constantly changing (“mutable government”), either by growing enormously in size to be beyond the grasp ordinary people, or by being incoherent, or being repealed or revised before they are promulgated.

Today we have the situation where massive and complicated laws, like ObamaCare (over 3,000 pages) are passed without having been read or debated by the legislators themselves, let alone discussed in the press and by the people. When this sad state has been reached, the law itself, as Madison eloquently says, “poisons the blessings of liberty.” James Madison stated in Federalist No. 62:

“To trace the mischievous effects of a mutable government would fill a volume. I will hint a few only, each of which will be perceived to be a source of innumerable others.

In the first place, it forfeits the respect and confidence of otherJames_Madison nations, and all the advantages connected with national character. An individual who is observed to be inconstant to his plans, or perhaps to carry on his affairs without any plan at all, is marked at once by all prudent people, as a speedy victim to his own unsteadiness and folly. His more friendly neighbors may pity him, but all will decline to connect their fortunes with his: and not a few will seize the opportunity of making their fortunes out of his. One nation is to another, what one individual is to another; with this melancholy distinction perhaps, that the former, with fewer of the benevolent emotions than the latter, are under fewer restraints also from taking undue advantage of the indiscretions of each other. Every nation, consequently, whose affairs betray a want of wisdom and stability, may calculate on every loss which can be sustained from the more systematic policy of its wiser neighbors. But the best instruction on this subject is unhappily conveyed to America by the example of her own situation. She finds that she is held in no respect by her friends; that she is the derision of her enemies; and that she is a prey to every nation which has an interest in speculating on her fluctuating councils and embarrassed affairs.

The internal effects of a mutable policy are still more calamitous. It poisons the blessing of liberty itself. It will be of little avail to the people, that the laws are made by men of their own choice, if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood; if they be repealed or revised before they are promulgated, or undergo such incessant changes that no man, who knows what the law is to-day, can guess what it will be to-morrow. Law is defined to be a rule of action; but how can that be a rule, which is little known, and less fixed?

Another effect of public instability is the unreasonable advantage it gives to the sagacious, the enterprising, and the moneyed few over the industrious and uniformed mass of the people. Every new regulation concerning commerce or revenue, or in any way affecting the value of the different species of property, presents a new harvest to those who watch the change, and can trace its consequences; a harvest, reared not by themselves, but by the toils and cares of the great body of their fellow-citizens. This is a state of things in which it may be said with some truth that laws are made for the FEW, not for the MANY.

In another point of view, great injury results from an unstable government. The want of confidence in the public councils damps every useful undertaking, the success and profit of which may depend on a continuance of existing arrangements. What prudent merchant will hazard his fortunes in any new branch of commerce when he knows not but that his plans may be rendered unlawful before they can be executed? What farmer or manufacturer will lay himself out for the encouragement given to any particular cultivation or establishment, when he can have no assurance that his preparatory labors and advances will not render him a victim to an inconstant government? In a word, no great improvement or laudable enterprise can go forward which requires the auspices of a steady system of national policy.

But the most deplorable effect of all is that diminution of attachment and reverence which steals into the hearts of the people, towards a political system which betrays so many marks of infirmity, and disappoints so many of their flattering hopes. No government, any more than an individual, will long be respected without being truly respectable; nor be truly respectable, without possessing a certain portion of order and stability.”

In Federalist Paper 10, probably the most important of the Federalist Papers, James Madison, writing as Publius, addresses the Tyranny of the Majority trough Factions.

“Complaints are everywhere heard from our most considerate and virtuous citizens, equally the friends of public and private faith and of public and personal liberty, that our governments are too unstable, that the public good is disregarded in the conflicts of rival parties, and that measures are too often decided, not according to the rules of justice and the rights of the minor party, but by the superior force of an interested and overbearing majority. However anxiously we may wish that these complaints had no foundation, the evidence of known facts will not permit us to deny that they are in some degree true.”

As I have stated in previous blogs in 2007, Congress enacted 138 public laws, while federal agencies finalized 2,926 rules, including 61 major regulations.” In this context, it is irrelevant who resides in the White House or holds the House speaker’s gavel. America is not a nation of laws, but of rules. Only a renewed cultural will to true reform, coupled with political leadership, can correct that.

Today we are experiences the worst of our Founder’s fears. An unfettered executive branch coupled with a legislative branch that is so encumbered with factions that it no longer serves the will of the people. This combination of ills has formed a fourth branch of government — the administrative state.

I have written numerous times about the history and tyrannical effects of the administrative state and how it is slowly destroying the republic our Founders envisioned. The latest egregious example is the Senate passed 1,200 page immigration bill that contains so much pork a pig farmer would have problems weighing it. It contains cars for immigrants to placate Senator Barry Sanders of New Hampshire and subsidies for the Alaskan fishing industry. It states that the counterfeiting of no more than three U.S. passports is not a crime. While allowing for the hiring of 20,000 additional border patrol agents and building a fence along the entire border it gives the Department of Homeland Security the power to cancel the fence construction at any time at their discretion.

Today a landmark Supreme Court ruling that struck down a key part of the Voting Rights Act has set up a stand-off between Republican-led states and the Obama administration over controversial voting laws that until now had been stalled.

The 5-4 ruling on Tuesday addressed a 1960s-era provision that largely singled out states and districts in the South — those with a history of discrimination — and required them to seek federal permission to change their voting laws.

The court ruled that the formula determining which states are affected was unconstitutional.

In doing so, the court potentially opened the door for certain states to proceed with voter ID laws and other efforts that to date had been held up because of the Voting Rights Act. Prominent among those are voter identification laws in Alabama and Mississippi.

Yet Attorney General Eric Holder has claimed that he does not agree with theWas7541345 ruling and will continue to do all he can to force states to abide by his edicts

Attorney General Eric Holder warned states against going too far. He said the Justice Department would not hesitate to take "swift" action against states looking to "take advantage" of the ruling.

He, like President Obama, said he was "deeply disappointed" in the decision, saying discriminatory practices live on and need to be addressed.

"These problems have not been consigned to history," Holder said.

Holder and Obama urged Congress to create a new formula.

"Today's decision invalidating one of its core provisions upsets decades of well-established practices that help make sure voting is fair, especially in places where voting discrimination has been historically prevalent," Obama said.

In another example of the power of the administrative state today Obama declared his war on coal even though throughout the 2012 election campaigned he denied such a war on coal or guns.

So much for the denials. An administration that throughout its 2012 election campaign denied it was waging a War on Coal has now come out and publicly declared its intention to shut down coal-fired power plants – putting hundreds of thousands of Americans out of work and sending electricity prices skyrocketing.

This is not what the American people voted for.

Responding to a White House petition to end the War on Coal, the administration said: “The President has made clear that he understands that coal has played a critical role in our country’s energy portfolio for decades and will continue to be an important source of energy in the future.”

Sycophantic liberal media outlets (like The Nation and the Associated Press) went further, repeatedly claiming that the War on Coal was a myth. The Obama campaign even ran a TV ad in Ohio claiming that Mitt Romney would be bad for coal – and trotted out former Democratic Gov. Ted Strickland to deny there was a war on coal and echo the attacks on Romney.

Yet today Obama political consultant David Plouffe took to Twitter to bang his chest: “Today's climate announcement underscores that elections matter greatly” – as if Obama had campaigned on shutting down coal plants instead of on denying his intention to do so.

Such denials are no longer necessary. Today a top Obama global warming adviser told The New York Times the denials were just election-year politics. Daniel Schrag said: “Politically, the White House is hesitant to say they’re having a war on coal. On the other hand, a war on coal is exactly what’s needed.

And Obama delivered. It’s right there on page 19 of his Climate Action Plan: “Going forward, we will promote fuel-switching from coal to gas for electricity production.”

Indeed, Obama made clear in his speech that he intends to impose regulations on existing coal plants that can only be met through carbon capture and storage (technology that doesn’t exist on a commercial scale), switching to natural gas, or shutting down completely.

Coal still produces 37 percent of U.S. electricity. A Heritage Foundation analysis found that implementing Obama’s proposed regulation on existing coal plants would destroy more than 500,000 jobs, slash the income of a typical family of four more than $1,400 a year, and increase electricity prices at least 20 percent. Price spikes could be much higher in states that depend heavily on coal-fired power plants, especially in the Midwest. President Obama once famously explained that he intended to make electricity prices “necessarily skyrocket.”

Obama intends to fight his War on Coal by issuing a PresidentialAP401450731793 Memorandum to the EPA to issue regulations under the 1970 Clean Air Act. This is despite the fact that the law’s principal author, Democrat John Dingell of Michigan, famously said: “This is not what was intended by the Congress and by those of us who wrote the Clean Air Act. We are beginning to look at a wonderfully complex world, which has the potential for shutting down or slowing down virtually all industry and all economic activity and growth.”

And there is zero global warming benefit to go with all the economic costs, because even if all United States greenhouse gas emissions were shut down to zero tomorrow, the rest of the world would keep on puffing. Paul Knappenberger recently calculated, based on standard assumptions, that getting to zero emissions in the U.S. immediately would only reduce global average temperatures an imperceptible 0.08 degrees Celsius by 2050. Moreover, the rest of the world would replace all U.S. emissions within seven years.

So it’s all pain and no gain — by legally dubious means — to accomplish the opposite of what Obama promised on the campaign trail. Congress should take exception to being circumvented and step in to stop Obama’s (now-declared) War on Coal.

Once again it is plain to see that complex laws passed by a willing legislature leave the door open for the executive branch to do just about anything it wants under the color of law. This is truly a feature of the administrative state where the masterminds call the shots and self-government is a thing of the past. So much for the Republic Mr. Franklin.

On the other hand 62 Tea Party representatives dealt a blow to the Republican leadership of the House of Representatives when they gather enough support to defeat an overblown Farm Bill on June 20th.

The GOP leadership suffered a stunning defeat as 62 Republicans voted against the 5-year farm bill (H.R. 1947), which locks in the record baseline of food stamp spending and creates multiple new agriculture subsidy programs. A handful of them voted against it because it cut too much spending, and others like Bill Shuster voted no because they are facing potential primary challenges (Shuster voted for the 2008 bill). But this is a strong showing, as it is a dynamic none of us would have ever predicted several years ago.

Some Republicans are complaining that because of the conservative revolt we will now continue on the status quo with direct farm subsidies. But they fail to understand that the new price support programs and shallow loss coverage that were created by this bill would have been more expensive and represent worse market distortions than direct subsidies. It’s better to reauthorize the status quo than to pass a long-term bill that creates even more problems and precludes real reforms for another 5 years.

Other Republicans complain that now we will face the so-called milk cliff. Pursuant to a silly 1949 act of Congress, every time we fail to renew expiring farm programs, the government must begin imposing Soviet-style price controls on milk by decreasing supplies through massive purchases of milk, butter, cheese, and other dairy products. Under permanent law, the USDA would begin purchasing dairy products at a rate of $38.54 per hundredweight; more than double the current price ($18 per hundredweight). This market manipulation could double the price of milk, dairy products, and everything else up the food chain.

clip_image001But instead of avoiding the deleterious effects of the Agriculture Act of 1949 by growing government, why don’t we just repeal the damn law?

In a sane world, both houses of Congress would convene and repeal this inane and outdated law within a few minutes by unanimous consent. That way we could debate a long-term farm bill without having the sword of the 1949 law brandished over our necks and forcing Congress to rush through bad legislation.

However, Congress is not sane, and they have no plans to repeal the law. In fact, Paul Broun introduced an amendment to do just that, but all the Democrats and more than half of Republicans voted it down.

The latest ephemeral trend in Washington is to create a contrived crisis for the purpose of growing government, increasing spending, or raising taxes. The new “milk cliff” is just the latest in the bag of tricks held by the permanent statist class.

Moving forward, we must split up the farm bill into two components; food stamps and agriculture programs. Food stamps must be devolved to the states and most agricultural subsidies need to be means-tested and charted on a gradual course towards elimination. And most of all, the dairy supply control system must be repealed once and for all in a standalone piece of legislation.

That would represent responsible conservative reform that is becoming of a GOP-controlled House. Working harder to buy off Democrats with more spending increases is not the way forward. If Kevin McCarthy and Eric Cantor desire to grow government with Democrat support, maybe they should run for the Pelosi whip team.

The American people elected a Republican House to provide a bold contrast to the Obama-Pelosi agenda, not to work behind the scenes to help grow government with their support.

One of the things all tyrannical regimes such as the administrative state does is to compile a list of enemies. These enemies are defined as those who do not agree with their policies and could pose a threat to their agenda.

The vast majority of the annual shooting homicides are committed by inner-city and minority youths below the age of 30. Handguns are involved in 80% of all murders. Rifles and shotguns account for less than 10% of homicides.

No matter; the National Rifle Association is now blamed for generic gun violence, especially the mass shootings at schools, even though usually no one knows of any proposed gun law — barring outright confiscation of previously purchased firearms, bullets, and clips — that would have prevented the shooters at Sandy Hook and Columbine. Gun merchants are blamed by the president while in Mexico for selling lethal semi-automatic weapons to drug cartels. But so far, the only identifiable purveyor of illegal weaponry is the president’s own attorney general, whose subordinates in the Fast and Furious operation sold hundreds of guns illegally to Mexican drug lords.

Suggestions to encourage greater incarceration of the mentally unstable, to jawbone Hollywood about its profitable (and gratuitous) gun violence, to regulate extremely violent — and extremely well-selling — video games usually fall on deaf liberal ears. In short, the stereotyped camouflaged, weekend gun enthusiast is not the problem that leads to Columbine, or the nearly 532 murders last year in Chicago. But because we can’t or won’t address the causes of the latter, we go after the former. He is not the unhinged sort that shoots a Gabby Giffords or innocents in an Aurora, Colorado, theater; but somehow is the supposed red-neck yokel that a journalist like ABC’s Brian Ross assumes does.

If the Department of Homeland Security, as is rumored, really did wish to stockpile hundreds of millions of rounds of ammunition, then why did it begin such repository buying right in the middle of a hysterical national debate about limiting access to various rifles and semi-automatic weapons? Was it not to create a climate of fear and panic buying that has emptied America’s shelves of the most popular types of ammunition? If the homicide rate in Philadelphia and Chicago is any indication, murderers still have plenty of access to bullets. Those who want to target practice or shoot a varmint on their property do not.

The CIA and FBI knew of the suspicious activity of the Boston bombers, of Major Hasan, and of Anwar al-Awlaki. And they did nothing to preempt their violence. The FBI is said to be carefully avoiding monitoring mosques, although all of the above terrorists were known by many fellow Muslim worshipers to be either disturbed or extremist or both. In contrast, the NSA monitors, we are told, nearly everyone’s communications rather than focusing on Middle Eastern male Muslims, even though Middle Eastern male Muslims have been involved in the vast majority of post-9/11 terrorist plots. The NSA is the electronic version of the TSA, which feels it is noble and liberal to stop an octogenarian in a wheel chair for special frisking as proper compensation for every focused look at a West Bank resident or Pakistani visitor on his way into the United States.

The words “Tea Party” and “patriot” in a non-profit’s name would more likely earn a negative appraisal from the IRS than would “Islam” or “Muslim.” One wonders how Lois Lerner’s IRS division would treat a hypothetical “Sarah Palin Foundation” versus “The Dr. Zawahiri Charity.”

The IRS is not worried at all about 47% of the nation who pay no federal income taxes. The vast majority of those whom it focuses on are instead the 10% who pay over 70% of all taxes. These are the would-be proverbial “fat cats” who did not build their own businesses. They are reluctant to spread their wealth. They certainly did not know either when to stop making money or when the age of profit altogether had passed. Sometime around 2009 success was deemed failure, and failure success — at least if we collate the president fat-cat rhetoric with the vast expansion in the disability, food-stamp, and unemployment-insurance rolls.

Note that the IRS is not interested in leaking to Democrat senators or former administration official rumors about George Soros’s income or the details of the tax returns of Warren Buffett, Steven Spielberg, or Bill Gates. Instead, the Democratic majority leader in the Senate bragged that he knew (falsely as it turned out) that Mitt Romney paid no income taxes. And former high administration official Austan Goolsbee claimed (also falsely as it turned out) that he too knew that the Koch brothers were shorting the IRS.

Note that only liberal groups like ProPublica leak information about the confidential donor lists of conservative activists, apparently given their familiar arrangement with the IRS. So far IRS chiefs are not looking at prominent Democrat politicians for tax violations, although for a time — cf. Tim Geithner, Tom Daschle, Hilda Solis — that might have been a fruitful profile for inquiry. (One encouraging side note: if you are a suspect white, mature, well-off, conservative, heterosexual, Christian male, you can still obtain exemption from federal suspicion by loudly announcing that you also are enthralled by Barack Obama.)

We know who was not an administration suspect in the killing of four Americans in Benghazi — hard-core, al Qaeda-related Islamic terrorists. Instead a supposedly right-wing unhinged video-maker was the object of vitriol from the secretary of state, the UN ambassador, and the president of the United States. He currently sits in jail. The known perpetrators of the murders walk free. In contrast, Lisa Jackson, the former EPA director, just got a fat inside job from Apple, despite creating not just a fictitious name (e.g., “Richard Windsor”) to avoid scrutiny when she communicated official business, but also an entirely made-up alter ego: “Richard Windsor” became an ideal employee lauded by the unethical EPA for his supposedly “ethical behavior.”

We also know who in the media is not a target. Not the CBS or ABC News presidents who have siblings working in the White House. Not ABC’s Good Morning America, given that one of its stalwarts is married to Press Secretary Jay Carney. Instead, there are two sorts of suspicious reporters that are considered hostile to the administration and worthy of having their communications monitored. One group are those journalists who leak information that the administration wished to preempt and leak first or who refuse to only leak favorable classified information — the bin Laden trove, the cyber war against Iran, the drone targeting protocol — that makes the president look as if he were a competent commander in chief.

The other target, of course, is Fox News, whose staff, in a variety of ways and on a number of occasions, the Obama administration has previously attacked as in some way illegitimate.

Again, who fits these profiles that our current, vastly expanding big government does not like? If you are an operator of a coal plant that creates needed energy at a profit, then beware that the EPA is after you. If you are a shady insider who wants tens of millions of government dollars to subsidize a money-losing wind and solar plant, you hit the jackpot. Ditto the suspect people who build guitars, loan money to Chrysler, or wish to locate a jet airliner plant in South Carolina. Profits create suspicion; failures earn subsidies.

Then there are the clingers, whom the president long ago blasted as religious zealots and gun-toting xenophobes. These are the sorts whom the attorney general calls “cowards” (not “my people”) — the “enemies” whom the president advises Latino activists to “punish” at the polls, the sorts that the president apologizes for abroad as guilty of sundry sorts of past class, race, and gender oppression.

In contrast, who is not so worried about government surveillance or audit? The New Black Panthers who turned up at a polling station in Philadelphia to intimidate voters; the “farmers” who, according to the New York Times, filed bogus claims to cash in on the government’s ill-advised and poorly administered Pigford settlement; the Secret Service agents who routinely visited prostitutes while on duty protecting high government officials abroad; and the assistant to Secretary of State Hillary Clinton who used her office to enhance her private consulting business.

Americans wonder whom would the immigration services more likely wish to deport: the German Romeike family that was “guilty” of homeschooling their children; Obama’s aunt Zeituni, who lied about her immigration status to illegally obtain state and federal subsidies; or Onyango Obama, who likewise is here illegally (for 21 years) and was recently charged with ramming a police car while driving intoxicated? Is the U.S. so short of DUI offenders and frauds that we must deport homeschoolers to make room for them?

There is currently a climate of fear growing throughout the United States. Millions of Americans are terrified of the IRS, the Department of Justice, the EPA, U.S. Immigration and Customs Enforcement, and even perhaps the FBI, CIA, and State Department.

Why?

These government agencies have never been bigger, more powerful, and more ideologically driven. Citizens fear them for understandable reasons: those who do nothing wrong, whether in filing tax forms or trying to buy a rifle, are considered suspect and deserving to be the target of either federal scrutiny or presidential slurs. But those who do a great deal of wrong, either by illegally entering the country, disrupting polling, trafficking in weapons in Mexico, eavesdropping on American citizens, pulling tax information for partisan purposes, subverting a government agency, or lying to the public about government activity, seem exempt from punishment — and, more chillingly, sense that they are so exempt.

Ask who now is sitting in prison — a shyster video-maker who had nothing to do with the deaths of four Americans, or their five known terrorist killers lounging about in North Africa? Apparently, Nakoula Basseley Nakoula, like EPA director Lisa Jackson, was guilty of creating a fake persona. Like Labor Secretary Hilda Solis, he had a lien on her business. Like former Treasury Secretary Timothy Geithner, he had some unpaid taxes. Like Tamerlan Tsarnaev, he had been visited by government investigators. Like Attorney General Eric Holder and Director of National Intelligence James Clapper, he lied to federal authorities — although they were not quite as high as those in the U.S. Congress. And unlike all of the above, he was therefore jailed.

Of all the legacies of Barack Obama, the most pernicious will be the creation of a rogue government that has cut off and terrified half the population — and for no other reason than that they seem to represent things that Mr. Obama simply does not seem to understand.

The truth is that governments are always like pitchers trying to pitch out of a jam with all the bases loaded. We the people want a little free stuff. The ruling class wants to seize and hold political power. Promising free stuff is how you get elected. This what James Madison knew when he authored Federalist No. 10.

Usually, those vote-buying promises result in policies that damage the economy. President Obama has been worse than most. The result is that politicians and their officials are always involved in trying to Band-Aid over the distortions and the wounds they have inflicted on the economy and our freedoms in their crude bid for power.

Did The IRS Scandal Begin at the Top

“It will be of little avail to the people that the laws are made by men of their own choice if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood.” ― James Madison, Federalist No. 62, 1788

When James Madison issued the words quoted above in Federalist No. 62 he could have been speaking about the current U.S. Tax Code. In Federalist 62 Madison was addressing how the Senate should be constructed and empowered. He wrote the following pertaining to voluminous, complicated, and mutable laws:

“The internal effects of a mutable policy are still more calamitous.

In a word, no great improvement or laudable enterprise can go forward which requires the auspices of a steady system of national policy.”

Madison wrote these words 225 years ago in support of ratification of the newly adopted constitution. If he were alive today he would not only be appalled at the U.S. Tax Code, ObamaCare and the millions of regulations issuing forth from the various departments of executive branch. Although Congress has authorized these departments such as the IRS, Health and Human Services, the EPA, the Departments of Energy, Education, Agriculture, Treasury, and Interior the power to regulate and issue regulations they rarely read, or even are aware of the regulations and he impact they have on we the people.

This brings us to the current scandal brewing to a boil of the illegal actions of the IRS in targeting Tea Party and conservative organizations by slow-walking or denying their applications for a 501(c)(4) tax exemption.

The spin from Obama’s minions in the press and his spokespersons know and “strategist” is that this policy originated from some low-level drones working in the Cincinnati office of the IRS. This is pure unadulterated balderdash!

Was the White House involved in the IRS's targeting of conservatives? No investigation needed to answer that one. Of course it was.

President Obama and Company are in full deniability mode, noting that the IRS is an "independent" agency and that they knew nothing about its abuse. The media and Congress are sleuthing for some hint that Mr. Obama picked up the phone and sicced the tax dogs on his enemies.

Mr. Obama now professes shock and outrage that bureaucrats at the IRS did exactly what the president of the United States said was the right and honorable thing to do. "He put a target on our backs, and he's now going to blame the people who are shooting at us?" asks Idaho businessman and longtime Republican donor Frank VanderSloot.

Mr. VanderSloot is the Obama target who in 2011 made a sizable donation to a group supporting Mitt Romney. In April 2012, an Obama campaign website named and slurred eight Romney donors. It tarred Mr. VanderSloot as a "wealthy individual" with a "less-than-reputable record." Other donors were described as having been "on the wrong side of the law."

This was the Obama version of the phone call — put out to every government investigator (and liberal activist) in the land.

Twelve days later, a man working for a political opposition-research firm called an Idaho courthouse for Mr. VanderSloot's divorce records. In June, the IRS informed Mr. VanderSloot and his wife of an audit of two years of their taxes. In July, the Department of Labor informed him of an audit of the guest workers on his Idaho cattle ranch. In September, the IRS informed him of a second audit, of one of his businesses. Mr. VanderSloot, who had never been audited before, was subject to three in the four months after Mr. Obama teed him up for such scrutiny.

The last of these audits was only concluded in recent weeks. Not one resulted in a fine or penalty. But Mr. VanderSloot has been waiting more than 20 months for a sizable refund and estimates his legal bills are $80,000. That figure doesn't account for what the president's vilification has done to his business and reputation.

The Obama call for scrutiny wasn't a mistake; it was the president'sobama_angry1-620x413 strategy — one pursued throughout 2012. The way to limit Romney money was to intimidate donors from giving. Donate, and the president would at best tie you to Big Oil or Wall Street, at worst put your name in bold, and flag you as "less than reputable" to everyone who worked for him: the IRS, the SEC, the Justice Department. The president didn't need a telephone; he had a megaphone.

The same threat was made to conservative groups that might dare play in the election. As early as January 2010, Mr. Obama would, in his state of the union address, cast aspersions on the Supreme Court's Citizens United ruling, claiming that it "reversed a century of law to open the floodgates for special interests" (read conservative groups).

The president derided "tea baggers." Vice President Joe Biden, Senate Majority Leader Harry Reid, and Nancy Pelosi compared them to "terrorists." In more than a dozen speeches Mr. Obama raised the specter that these groups represented nefarious interests that were perverting elections. "Nobody knows who's paying for these ads," he warned. "We don't know where this money is coming from," he intoned.

In case the IRS missed his point, he raised the threat of illegality: "All around this country there are groups with harmless-sounding names like Americans for Prosperity, who are running millions of dollars of ads against Democratic candidates. And they don't have to say who exactly the Americans for Prosperity are. You don't know if it's a foreign-controlled corporation."

On the other hand “as applications from conservative groups sat in limbo, groups with obviously liberal names were approved in as little as nine months”, USA Today reported last Tuesday. These included Bus for Progress and Progress Florida.

According to the Daily Caller’s Charles C. Johnson, the Barack H. Obama Foundation — directed by Abongo Malik Obama, the president’s half-brother and best man at his wedding — filed IRS Form 990s for 2008 through 2010 in May 2011. It then scored 501(c)(3) tax-exempt status on June 26, 2011, retroactive to April 30, 2008. The reputedly Virginia-based foundation won this valuable designation without registering with state authorities. Evidently, IRS officials did not care that, as the Daily Caller stated, Abongo Obama “was accused of being a wife beater and seducing the newest of his twelve wives while she was a 17-year-old school girl.”

IRS also sent ProPublica, a liberal news organization, the confidential, unapproved nonprofit applications of nine conservative groups. ProPublica redacted financial information and then published six of these forms.

A pro-traditional-matrimony group called the National Organization for Marriage claims that the IRS gave copies of its tax documents to the pro-gay-marriage Human Rights Campaign. NOM says that HRC used those leaked documents to slam NOM and a donor identified therein: Mitt Romney.

IRS wants to hire 1,954 new agents to enforce 47 different provisions of ObamaCare. Combine these political leaks with the electronic medical records that doctors and insurers soon must render unto Obama’s bureaucrats. Imagine an exposé on conservative activists who use Viagra. Why not out a rising GOP star whose psychotherapist treats her exotic sex fantasies? Far-fetched? Not after this week. Indeed, 15 IRS agents are being sued in California court for allegedly swiping without a search warrant the medical records of some 10 million Americans in March 2011.

Short of directly asking federal agencies to investigate these groups, this is as close as it gets. Especially as top congressional Democrats, like Chuck Schumer and Max Baucus were putting in their own versions of phone calls, sending letters to the IRS that accused it of having "failed to address" the "problem" of groups that were "improperly engaged" in campaigns. Because guess who controls that "independent" agency's budget?

The IRS is easy to demonize, but it doesn't exist in a vacuum. It got its heading from a president, and his party, who did in fact send it orders — openly, for the world to see. In his Tuesday press grilling, no question agitated White House Press Secretary Jay Carney more than the one that got to the heart of the matter: Given the president's "animosity" toward Citizens United, might he have "appreciated or wanted the IRS to be looking and scrutinizing those." Mr. Carney cut off the reporter with "That's a preposterous assertion."

Preposterous because, according to Mr. Obama, he is "outraged" and "angry" that the IRS looked into the very groups and individuals that he spent years claiming were shady, undemocratic, and even law-breaking. After all, he expects the IRS to "operate with absolute integrity." Even when he does not.

So who are these low-level drones responsible for the illegal actions of the IRS?

Steven Miller — the acting head of the Internal Revenue Service while the scandal unfolded. He was fired from the post on Wednesday after an internal IRS report found that poor management, and not partisan politics, led to an "inappropriate" focus on conservative groups starting in 2010. The IRS has acknowledged Miller knew about the targeting of conservative groups in 2012 but did not disclose the practice. He was the former deputy IRS commissioner for services and enforcement and had been at the agency for more than 25 years.

At a House of Representatives hearing last Friday, Miller apologized for "foolish mistakes" made at the IRS and said they resulted from a heavy workload. He leaves the agency in June.

Douglas Shulman — IRS commissioner before Miller took over in the acting capacity in November 2012. A Democrat, he was appointed to the post under Republican President George W. Bush in 2008.

In March 2012, Shulman told lawmakers that IRS personnel applied no extra scrutiny to conservative groups, although the new report from the Treasury Inspector General for Tax Administration (TIGTA) said that Miller knew of the targeting as early as March 8, 2012.

Congressional leaders sent letters to Shulman inquiring about IRS targeting as early as June 2011. According to the inspector general, the IRS's Determinations Unit began targeting conservative groups in March or April of 2010.

Danny Werfel — the White House budget official selected by Obama to replace Miller as acting IRS chief on May 22.

The Obama administration's point man in overseeing the "sequestration" budget cuts, he will now tackle the IRS scandal.

Lois Lerner — director of the IRS's tax-exempt division who broke the news of the scandal on May 10 at an American Bar Association function when she publicly apologized for the discriminatory practices. The admission came just days after she testified in Congress but did not mention it. According to the inspector general, Lerner learned about the targeting as early as June 29, 2011.

Lawmakers have called for her removal from the IRS.

Miller on Friday acknowledged that the scandal-exposing question-and-answer session had been planned.

Joseph Grant — IRS acting commissioner of tax exempt/government entities division at the center of the scandal. On last Thursday he announced plans to retire on June 3 after joining the IRS in 2005. He took over the reins of the tax exempt division in late 2010 and Lerner worked under him.

Sarah Hall Ingram — Preceded Grant as head of the IRS's tax-exempt division when the targeting of conservative groups began. Since December 2010, she has headed up the IRS division handling Obama administration's healthcare reform and received $103,000 in bonuses.

William Wilkins — IRS chief counsel who is an Obama political appointee. He is the top legal adviser and takes the lead on all litigation involving the IRS. His office, although not necessarily Wilkins personally, knew of the targeting as early as August 2011, according to TIGTA. The IRS said Wilkins did not participate in the August 2011 meeting, which the agency said involved "staff attorneys several layers below Wilkins."

J. Russell George — Treasury Department inspector general for tax administration. Investigated the complaints against the IRS and issued the public report on targeting of conservative groups. The IRS is an arm of the Treasury Department and lawmakers at the hearings are scrutinizing George for not issuing warnings about the practice earlier.

IRS's Cincinnati field office employees — oversaw the reviews of tax-exempt applications. According to TIGTA, the Ohio unit set its own criteria for checking tax-exempt groups in the absence of clear guidance from more senior officials.

Republican lawmakers have named five workers they hope to bring in for questioning: Holly Paz, Washington-based director of rulings and agreements for the tax exempt division; Greg Muthert, a veteran Cincinnati office worker; Joseph Herr and Elizabeth Hofacre, who were cited by some Tea Party groups as handling their tax-exempt applications; and John Shafer, whom lawmakers described as "screening group manager."

A congressional aide said the five workers were chosen based on a timeline from the TIGTA report that listed the job roles involved in the activity. It was unclear whether these employees had any role in any wrongdoing.

President Barack Obama — has said he was not aware of the ongoing practice, calling it intolerable and inexcusable. His Press Secretary Jay Carney said the White House Counsel was notified of the IRS's targeting during the week of April 22.

Obama has appeared multiple times in public to condemn the IRS's actions and has promised to cooperate with congressional investigations and a Justice Department probe, but he has not demanded a special prosecutor look into the allegations.

Representative Dave Camp — Republican chairman of the House Ways and Means Committee that is investigating the matter. On June 3, 2011, he sent a letter to then-Commissioner Shulman, inquiring about IRS targeting of taxpayers who donated to conservative groups and audits of tax-exempt organizations. The IRS then halted reviews of any tax-exempt groups but never addressed targeting concerns.

Representative Darrell Issa — Republican chairman of the Oversight and Government Reform Committee also conducting an investigation. He is seeking interviews with five IRS employees to learn more about the tax-exempt reviews.

Senator Max Baucus — Democratic chairman of the Senate Finance Committee, who said his tax code revamp will examine rules for nonprofit group's political activities in hopes of preventing such scandals in the future.

It should be obvious to anyone who can read or watch the TV news that these individuals are not low-level drones working in the Queen City. I am sure this list will grow as the hearings

The Washington Post’s editorial board wrote that, “A bedrock principle of U.S. democracy is that the coercive powers of government are never used for partisan purposes.”

In her apology, Lois G. Lerner, IRS director of exempt organization, insisted that the extra scrutiny was not politically motivated. The narrow focus on partisanship as the primary point of controversy is dangerous. This is not first and foremost a partisan issue.

It doesn’t matter whom the IRS was targeting or what specific beliefs they held: the fact remains that for years the agency used its power to coerce, discourage and intimidate Americans from speaking out against what they viewed as bad policies, stifling the First Amendment right of every citizen to hold government accountable.

The president says he was not aware of the problem. If so, then the state of our freedom is far worse than any of us has imagined — the gray suits of the administrative state are in place and already taking over.

Pundits have compared the current scandal to Watergate, but this one, frankly, is worse.

When the abuses of Watergate – which included misuse of the IRS to launch audits against Nixon’s enemies — were discovered, they stopped and the perpetrators were brought to justice.

We don’t yet know just how high the knowledge of the IRS practice reached, but it’s already clear that a broad element of the agency — including those with the power to stop it — knew about this blatant violation of basic constitutional rights for years and did nothing to stop it.

Despite Ms. Lerner’s statements to the contrary, it’s clear the IRS has been using its power for years to discourage and intimidate Americans from participating in their right to hold government accountable.

This abuse of power and “unequal treatment under the law” is truly chilling, and must not be brushed away with apologies or toothless inspector-generals’ reports.

It demands a rigorous congressional investigation and severe punishment of the power-drunk bureaucrats who carried it out.

No government agency must be allowed to abuse its powers so blatantly and get away with it. The freedom Americans hold so dearly is at stake.

We must demand that government account for its actions.

Sen. Mike Lee (R-Utah) rightly captured the problem in a written statement when he said, “this shameful abuse of power transcend partisan differences. This should not be dismissed as just another conflict between left and right; it is a conflict between the federal government and the American people.”

Sen. Ted Cruz (R-Texas) noted, “What’s just as concerning is the expansive role this agency is charged to take in enforcing ObamaCare. An agency that has admitted to engaging in such corrupt, political activities has no place assessing or monitoring Americans’ personal health information.”

Finally, Sen. Rand Paul (R-Ky.) said, “The First Amendment cannot and should not be renegotiated depending on which party holds power… I am determined to hold the IRS accountable for these unjust acts.”

We, the people, must demand that congressional leaders and the Obama administration get to the bottom of this issue and remove not just the responsible parties but the threat to our freedoms.

The IRS’s actions are the stuff of Third World juntas, not the greatest constitutional republic in human history.

It is unacceptable for a government agency use its power to intimidate American citizens into silence. We must stop this abuse of government over the governed and ensure this never happens again to any segment of the American population, regardless of their political leanings.

Will it be a Happy New Year?

“Of all the dispositions and habits which lead to political prosperity, Religion and morality are indispensable supports. In vain would that man claim the tribute of Patriotism who should labor to subvert these great Pillars of human happiness.” — George Washington, Farewell Address, 1796

Well we finally said goodbye to 2012 and the world did not come to an end as predicted by the promoters of the Mayan Calendar and we did, according to Vice President Joe Biden go off the fiscal cliff with the Senate passing the so-called compromise tax plan. Passage by the House will be an issue for 2013, so in reality nothing has changed so far.

2012 was not a great year for the world or the United States. There were no great medical or scientific breakthroughs. No one walked on the moon, in fact the United States relinquished its leadership in space to the Russians and we did not find a cure to the common cold. We did not introduce an automobile that would get 100 miles to the gallon and we could not figure out how to make airline travel more comfortable and less expensive.

In retrospect let’s take a few minutes to look back at some of the more reported and monumental events of the past year.

2012 began on January 13 when the Italian cruise ship Costa Concordia ranconcordia aground off the Tuscan island of Giglio, Italy, killing 32 people. The captain of the ship, unlike the captain of the Titanic, bailed out on his passengers claiming he was distracted causing the ship to run a ground and capsize.

On Feb. 11, 2012: Whitney Houston, who reigned as pop music's queen until her majestic voice and regal image were ravaged by drug use, died at 48. Houston, while having a great career and millions of fans, just could not avoid the use of drugs to make her feel good about herself.

Just Houston’s death was news was growing cold on Feb. 16, 2012 George Zimmerman fatally shot 17-year-old Trayvon Martin, an unarmed teenager who he described to 911 dispatchers as "suspicious." The case gained national attention and activists demanded Zimmerman be charged. He has pleaded not guilty to second-degree murder. His case is still pending and much criticism has been leveled against the Florida State Prosecutor for charging Zimmerman at all as Florida has a “Stand Your Ground Law.”

On March 15, 2012 Chongqing Party secretary Bo Xilai was removed from China's leadership in one of the biggest government shakeups since 1989. Bo is implicated in a corruption scandal that threatens to derail China's once-a-decade leadership transition.

In April 2012 as many as 11 Secret Service agents and 10 military service members allegedly brought prostitutes back to their hotel in Cartagena, Colombia, while setting up advance security before President Obama’s arrival for a three-day trade summit with Latin American leaders. This was one of the biggest black eyes for the Secret Service since the Kennedy assassination

On May 9, 2012 President Obama endorsed same-sex marriages, becoming the first sitting U.S. president to take that position. He reversed his previous position on the issue as he was campaigning for the LGBT vote.

On May 18, 2012 Facebook founder, Chairman and CEO Mark Zuckerberg, after years of anticipation, led to Facebook's initial public offering of stock in 2012, the hottest Internet IPO since Google's in 2004. On the eve of its first trading day, Facebook's market value was $105 billion, yet the IPO bombed. Zuckerberg and his investors made millions while those who bought in have yet to see any ROI.

In May 2012 the unemployment rate hit 8.2 percent in the United. In some states, like California and Nevada the rate remained as high as 12%.

In May/June 2012 Egypt held what the country touted as its first 'free-and-fair' presidential election. Muslim Brotherhood candidate Mohammed Morsi was declared the winner and the world wondered what had happened to the “Arab Spring.”

On June 6, 2012: Wisconsin Gov. Scott Walker Lt. Gov. Rebecca Kleefisch won their recall election. Organized labor, blind-sided by a new law weakening union rights in Michigan, point to Walker, who raised more than $30 million to beat his Democratic opponent, as a prime target in the 2014 elections. But the people of Wisconsin agreed with Walker by 53-46.

On June 25, 2012 the U.S. Supreme Court struck down much of Arizona's controversial immigration law, but upheld for now a key provision that requires police officers to check the immigration status of those they suspect may be in the country illegally. The provision on mandatory checks during routine stops will now kick back to a lower court for review and still could still be subject to challenge. The rest of the ruling, though, definitively strikes down three other provisions in the Arizona law. What a shame Arizona cannot protect its citizens from the drugs, crime, and harm to their economy illegal immigration brings.

On June 28, 2012 The Supreme Court upheld President Obama's health care overhaul. The court ruled as constitutional, by calling it a tax, the so-called individual mandate requiring most Americans to obtain health insurance starting in 2014. The ruling was a victory for the president, ensuring for now that his signature domestic policy achievement remains intact. This was one of the most controversial decisions from SCOUS since Dread Scott with years of unintended consequences lying ahead.

On July 20, 2012 the whack job James Holmes is accused of going on a July 20 shooting rampage at a midnight showing of the latest Batman movie in Aurora, killing 12 people and injuring 58 others.

On August 2, 2012 U.S. gymnast Gabrielle Douglas performs on the balance beam during the women's individual all-around gymnastics competition at the 2012 Summer Olympics in London. She is the first African-American gymnast in Olympic history to become the individual all-around champion, and the first American gymnast to win gold in both the individual all-around and team competitions at the same Olympics.

On September 11, 2012: A terrorist attack on the U.S. Consulate in Benghazi, Libya, killed U.S. Ambassador Chris Stevens, information specialist Sean Smith and former Navy SEALs Glen Doherty and Tyrone Woods. At first the Obama administration sent their U.N. ambassador, Susan Rice, around the Sunday talk shows to blame the attack on an anti-Muslim video, but as time went by Rice’s explanation was debunked and she lost all credibility with the press and American people causing her to withdraw herself from nomination as Secretary of State.

On September.24, 2012 a replacement official signaled a touchdown byReplacementRefereesYE Seattle Seahawks wide receiver Golden Tate, obscured, on the last play of an NFL football game against the Green Bay Packers in Seattle. The Seahawks won 14-12. The NFL locked out the officials in June after their contract expired. Unable to reach a new collective bargaining agreement, the league opened the season with replacements, most with experience only in lower levels of college football. This controversial call caused the NFL owners and the officials union to come to an agreement.

On October 9, 2012 former Penn State University assistant football coach Jerry Sandusky, is sentenced in Bellefonte, Pa. Sandusky was sentenced to at least 30 years in prison, effectively a life sentence, in the child sexual abuse scandal that brought shame to Penn State and led to Hall of Fame college football coach Joe Paterno's downfall disgrace. This scandal rocked the world of college athletics and brought sanctions against Penn State.

On October 14, 2012 Felix Baumgartner barreled toward the New Mexico desert from 24 miles above the Earth, shattering the sound barrier to become the world’s first supersonic skydiver. Baumgartner, a 43-year-old Austrian, hit Mach 1.24, or 833.9 mph, according to preliminary data, and became the first person to go faster than the speed of sound without traveling in a jet or a spacecraft. The capsule he jumped from had reached an altitude of 128,100 feet above Earth, carried by a 55-story ultra-thin helium balloon. Try that one with you kids party balloons.

On October 29 2012 Super Storm Sandy slammed into the East Coast in late October, killing at least 120 people, hurling a record-breaking 13-foot surge of seawater at New York City and knocking out power to more than 7.5 million across the East Coast. Some people still have not recovered from this storm an and once again FEMA and government was slow to respond even though President Obama made a campaign stop in the disaster area promising quick action.

On November 6, 2012 President Barack Obama and Vice President Joe BidenObamaWinsReelectionYE defeated Republican presidential nominee Mitt Romney and his running mate Paul Ryan in the 2012 election with 51% of the popular vote and 332 Electoral Votes. It was one of the most divisive elections since the Civil War and the nation has yet to see the full ramifications of Obama’s slim victory.

On November 21, 2012 Israel and Palestinian militants engaged in talks in Egypt aimed at forging a new era of relations between the bitter enemies following a November cease-fire that ended the heaviest fighting in nearly four years.

The cease-fire came following eight days of airstrikes targeting militant groups in the Palestinian territory and rocket attacks that reached deep into Israel.

Israel launched some 1,500 airstrikes in a bid to end rocket attacks out of Gaza, while the Hamas and the Islamic Jihad militant groups fired a similar number of rockets at Israeli cities. More than 160 Palestinians, including dozens of civilians were killed. Palestinian attacks killed Six Israelis, including four civilians and two soldiers. This was just the latest in the 64 year conflict between the Israelis and their Arab neighbors.

On November 9, 2012 CIA Director David Petraeus resigned after admitting toPetraeusScandalYE (1) an extramarital affair — an affair with his biographer, Paula Broadwell, that was revealed over the course of an FBI investigation spurned by a series of e-mails between Broadwell and her rival Jill Kelley.

December 3, 2012 Britain's Prince William and his wife Catherine, Duchess of Cambridge, announce that they were expecting their first child. Kate was hospitalized with severe morning sickness. An Australian radio show prank called the hospital pretending to be the Queen looking for information. The woman who connected the call committed suicide three days after being duped. Some prank.

On December 11, 2012 North Korea said it successfully launched a rocket, a feat which the U.S. and other nations have labeled as "provocative." The launch defied an international warning and took a major step forward in its quest to develop a nuclear missile. While the stated purpose was to put a weather satellite into orbit, the three-stage rocket's deployment also demonstrates the nation's ability to send a nuclear warhead as far as California, and raises the stakes in the international standoff over North Korea's expanding atomic arsenal.

On December 14, 2012 Adam Lanza, 20, shot his mother in the head four times in their Newtown, Conn., home and then drove to the Sandy Hook elementary school in her car with four guns, including a shotgun that was left in the back of the vehicle, and shot up two classrooms. Lanza killed 20 students and six adults before killing himself. It is one of the deadliest school shootings in U.S. history. It was the second greatest loss of life at a school since the 1927 bombing of an elementary school in Michigan.

In 2012 activists said more than 40,000 people have been killed in the 21-month Syrian civil war. Despite outcry from more than 100 nations, President Bashar Assad's regime continues to crack down on the Syrian people. The Assad regime has long rejected Western involvement in the civil war and has called for talks with opposition. Most rebel groups refuse to meet with Assad, demanding his removal. More than 100 nations, including the U.S., recognized the new Syrian opposition council as the legitimate representative of the country, a boost for the opposition forces that have been bombing regime targets in and around Damascus, once an impregnable stronghold of the Assad regime.

That is just a few of the events capturing the 24/7 news cycle during 2012. Each event in its own right was memorable or notorious, but were tossed into the dust bin of history as we moved through our daily cycle of news and entertainment.

As bad and tumultuous as events were here in 2012, things were worse in Europe. Fat sow unions in Europe and politicians who herald the umpteenth iteration of a Marxist panacea make nearly all the economic news from Europe bad, and the looming default on sovereign debt by Greece, Spain, Cyprus, and other Eurozone nations means that not just governments, but banks with sovereign debt instruments as significant parts of investment portfolios will lose solvency and confidence.

But the cliff we face and the cliff that Europe faces are less economic than moral. Two decades ago, we won the Cold War. The Iron Curtain fell. America, and to a lesser degree our NATO allies, all were able to safely and substantially cut defense spending. The "Peace Dividend" ought to have allowed Europe and America to keep taxes low, run regular surpluses, and not disrupt the social welfare basket at all.

What we have lost is not our money, but our souls. Consider Obama. He has power, but how is he using that power? Like Big Brother in Orwell's 1984, Obama never stops campaigning, never stops stirring up fear, never stops blaming those who came before him. Obama and his minions seem incapable of honesty, honor, or humility. Are Republicans in Washington much better? Since Reagan, who gave us the "Peace Dividend" and proved Supply-Side Economics, have conservatives ever found anyone in Washington who is not tainted with power-lust?

If Washington is bad, Brussels is worse. The dream of "United States of Europe" has become, instead, a nightmare. Flemings and Walloons, the two nationalities in Belgium in the very nation whose capital is the headquarters of the European Union, took 535 days after its last general election to form a government — longer than any parliamentary government in history (shades of Weimar Germany!). Self-destructive and angry Greeks dredged up Nazism when Angela Merkel visited their country to see what help Germany could provide. Separatism is on the rise in Europe, as Scottish and Catalan and Flemish and other peoples seem to think that a new and smaller nation will solve their problems, but there is no reason to think this will improve European life.

Old Europe itself is dying, as conservative authors have been telling us for years.  The cynical, agnostic, socialist European is reproducing at far too slow a rate to keep his native population from surviving and the young, militant jihadists who are taking over the streets of many European cities are no more tolerant or productive than the young, militant jihadists who are forming the new, scary democracies of the Arab world.

We have no talisman against these jihadists who will, inevitably, gain nuclear weapons through Pakistan (with hideous implications for India) or Iran (with hideous implications for Israel) or, through legitimate democratic means with implications for real nuclear powers like France and Britain (with hideous implications for us).

The problem which our civilized world is facing cannot be about money: Americans and Europeans were affluent and, with only modest restraints, would still be comfortable and secure. The problem we face cannot come from some wicked military enemy: Desert Storm proved that our armed forces are incomparably more powerful than any rival, and our troops each day in Afghanistan are winning battles easily, although they are dying from attacks from their “allies.”

The world today is deluged with things. Even the so-called poor in the United States and Europe have big flat screen TVs, cars, smart phones, expensive sport shoes, and computers. We are the richest poor people in the world.

The scary cliffs we see today — and our world is full of cliffs — is that too many people blessed to be born into the wealth and protection of the Western World have stopped believing that they are blessed at all; they have stopped believing in a loving God or in ordered liberty or even in such simple moral rules as "don't eat your children's seed corn." Our only hope, if we have any hope in the world today, is to forget about goodies and to embrace first goodness.

So as we embark on a new year what events will transpire in the next 365 days to be considered a memorable? Will our economy tank? Will the Arab world erupt in flames? Will the progressives advance their agenda of more government intrusion into lives? Who knows?

All I can do is wish you a happy and prosperous New Year and hope 2013 is better than 2012.

Can Republicans Increase Their Share Of The Hispanic Vote?

“When a portion of wealth is transferred from the person who owns it—without his consent and without compensation, and whether by force or by fraud—to anyone who does not own it, then I say that property is violated; that an act of plunder is committed.” — Frederic Bastiat (The Law)

Yesterday I quoted extensively from a Column by Charles Krauthammer in the Washington Post. In his column Mr. Krauthammer wrote referring to the future of the Republican Party:

“They lose and immediately the chorus begins. Republicans must change or die. A rump party of white America, it must adapt to evolving demographics or forever be the minority.

The only part of this that is even partially true regards Hispanics. They should be a natural Republican constituency: striving immigrant community, religious, Catholic, family-oriented and socially conservative (on abortion, for example). The principal reason they go Democratic is the issue of illegal immigrants. In securing the Republican nomination, Mitt Romney made the strategic error of (unnecessarily) going to the right of Rick Perry. Romney could never successfully tack back.

For the party in general, however, the problem is hardly structural. It requires but a single policy change: Border fence plus amnesty. Yes, amnesty. Use the word. Shock and awe — full legal normalization (just short of citizenship) in return for full border enforcement.”

While this may or may not be a strategy for winning elections by increasing the Hispanic vote conservatives must take a very cautious approach to this issue. It was Ronald Reagan who followed a similar course, but was sabotaged by Congress when they failed to secure the border allowing millions illegals to cross over our southern border.

Hispanic amnesty activists are expanding their goals beyond the so-called “DREAM Act” youth amnesty, towards a national amnesty for roughly 11 million Hispanic illegals.

President Barack Obama and Congress “need to come together to deliver change on immigration policy, and by that we mean a roadmap to citizenship for our parents and communities,” said Cristina Jimenez, director of an advocacy group, United We Dream.

According to an article in the Daily Caller Jimenez was born in Ecuador and arrived in this country as an illegal immigrant.

“Deporting members of our community is irresponsible and unacceptable,” added Lorella Praeli, the group’s policy director.

Their demand is an opening salvo in a post-election campaign to persuade the House GOP to provide “a path to citizenship” for roughly 11 million illegal immigrants, most of whom are low-skill laborers who compete for jobs against low-skill Americans.

The amnesty goal is supported by many progressive groups, in part, because most Hispanics prefer generous welfare policies, and so usually vote for Democratic candidates.

In contrast, many Republican advocates and legislators favor high-skill immigration, partly because high-skilled workers spur the economy and lower unemployment.

But the issue has been gridlocked because most GOP leaders prefer high-skill immigration, while most progressives believe that continued arrival of low-skill immigrants boosts their political power.

For example, the board of Jimenez’s group includes Josh Bernstein, the “immigration director” for the Service Employees International Union. That union’s membership has been boosted by the recruitment of many foreigners working without legal permission in the United States.

Polls show some support for amnesty, but other polls of working-class Americans in swing states show opposition.

Gov. Mitt Romney lost the 2012 election, in part, because of low turnout by blue-collar workers in Ohio and other states.

The renewed advocacy for an national amnesty comes as the formal unemployment rate among Americans ticked up to 7.9 percent.

Roughly 23 million Americans are unemployed or underemployed. Many additional low-skill workers Americans are paid low wages because employers have many potential job-applicants.

In June, Obama announced a temporary amnesty for roughly 800,000 younger illegal-immigrants.

That move greatly boosted Obama’s political support among Latinos prior to the Nov. 6 election.

Under this so-called “Deferred Action” measure, up to 1.76 million illegal immigrants could get work permits, according to an estimate by the Migration Policy Institute.

Only 6 percent of the eligible illegals have college educations, the MPI estimated.

However, Obama’s June decision isn’t enough, said Sonia Martinez, another young illegal immigrant working with the United We Dream group.

“I’m undocumented [and Deferred Action] is really important for me and my daughter. But we believe that Deferred Action is not enough for us,” she said.

“We’ll be fighting to keep families together,” instead of winning amnesty for younger illegal immigrants, she said.

The call for Republicans to discard their opposition to immigration amnesty will grow deafening in the wake of President Obama’s victory. Hispanics supported Obama by a margin of nearly 75 percent to 25 percent, and may have provided important margins in some swing states. If only Republicans relented on their Neanderthal views regarding the immigration rule of law, the message will run, they would release the inner Republican waiting to emerge in the Hispanic population.

If Republicans want to change their stance on immigration, they should do so on the merits, not out of a belief that only immigration policy stands between them and a Republican Hispanic majority. It is not immigration policy that creates the strong bond between Hispanics and the Democratic party, but the core Democratic principles of a more generous safety net, strong government intervention in the economy, and progressive taxation. Hispanics will prove to be even more decisive in the victory of Governor Jerry Brown’s Proposition 30, which raised upper-income taxes and the sales tax, than in the Obama election.

And California is the wave of the future. A March 2011 poll by Moore Information found that Republican economic policies were a stronger turn-off for Hispanic voters in California than Republican positions on illegal immigration. Twenty-nine percent of Hispanic voters were suspicious of the Republican Party on class-warfare grounds — “it favors only the rich”; “Republicans are selfish and out for themselves”; “Republicans don’t represent the average person”– compared with 7 percent who objected to Republican immigration stances.

It is estimated that each illegal immigrant costs the people of the State of California $22,000 per year. That’s equivalent to the cost of a very good new car each year or a year’s worth of payments on a $200.000 home mortgage. The County of Los Angeles is going broke with the burden imposed by the welfare and health care costs of illegal immigrants, people who have broken our laws by coming here illegally.

To me I cannot understand how giving illegals amnesty will help Republicans as according to the law a person cannot vote in a presidential election unless they are a citizen. This is an issue the Democrats have advanced on a purely emotional level in attempt to get the votes of citizens of Hispanic heritage. It is an issue the Republicans have not adequately explained to Hispanics or the American People on the whole.

According to Heather Mac Donald of the Manhattan Institute writing in National Review On “Line Why Hispanics Don’t Vote for Republicans:”

“I spoke last year with John Echeveste, founder of the oldest Latino marketing firm in southern California, about Hispanic politics. “What Republicans mean by ‘family values’ and what Hispanics mean are two completely different things,” he said. “We are a very compassionate people, we care about other people and understand that government has a role to play in helping people.”

And a strong reason for that support for big government is that so many Hispanics use government programs. U.S.-born Hispanic households in California use welfare programs at twice the rate of native-born non-Hispanic households. And that is because nearly one-quarter of all Hispanics are poor in California, compared to a little over one-tenth of non-Hispanics. Nearly seven in ten poor children in the state are Hispanic, and one in three Hispanic children is poor, compared to less than one in six non-Hispanic children. One can see that disparity in classrooms across the state, which are chock full of social workers and teachers’ aides trying to boost Hispanic educational performance.

The idea of the “social issues” Hispanic voter is also a mirage. A majority of Hispanics now support gay marriage, a Pew Research Center poll from last month found. The Hispanic out-of-wedlock birth rate is 53 percent, about twice that of whites.

The demographic changes set into motion by official and de facto immigration policy favoring low-skilled over high-skilled immigrants mean that a Republican party that purports to stand for small government and free markets faces an uncertain future.”

On election night, as the camera panned the audience waiting to hear Barack Obama give his victory speech, what struck me was that the audience was primarily young people and minorities. My thought was, "These are the very people who will suffer the most under a second Obama administration. Don't they know they are voting against their own best interest?"

And then I thought about it and came to the conclusion: "No, they don't." They don't because they are, by and large, uneducated. Oh, some of them may have college degrees or even graduate degrees, but they are still substantially uneducated. I would bet that very few of them know the difference between Keynesian economics and Austrian School economics. I am sure that most of them have never heard of the Laffer Curve. I would guess that most of them aren't familiar with the first principles behind the origin of our country. I doubt that many of them know what evil lies in Socialism or Communism, or unbridled leftism. Or are even aware that Barack Obama is a man of the left, and what that means. They, for the most part, have no idea what the concept of individual liberty is, nor how a big, powerful central government reduces that liberty. I also am pretty sure that they feel that Barack Obama is someone who cares about the poor, women, minorities, and the "middle class," and that Republicans don't. I would stake my substance on the fact that they don't know what is meant by a limited government, or what the Tenth Amendment says. I am certain that most of them don't know anything about Benghazi. Substantially uneducated!

For the past 40 or so years most of our K-12 (and college) educators have been teaching a progressive agenda and class warfare to their students. From kindergarten up they use text books that focus on social issues and downplay our heritage. In many of the urban school districts classes are taught in Spanish so as to provide this progressive agenda without the need for learning English. They are providing these students a crutch, a crutch that will keep them in low paying jobs and poverty so they will be dependent on government for their existence. Also this lack of learning to common language of the United States along with the lack of exposure to our founding principles and heritage tends to keep these immigrants (legal and illegal) in ghettos where politicians can exploit them for their support and votes and they become easy prey for unions like SEIU.

If you live in Germany, France or Italy you need to learn the language to exist. Unlike the United States in these countries official documents are in the native language. You cannot get a license to drive a vehicle unless you take a test in the native language and all ballots are only printed in the native language. The Bundestag or French Parliament does not have a black caucus or Hispanic caucus. Their legislatures are concerned with all of the people not just certain racial or ethnic special interest victim groups. You are either German, French or Italian or you are not.

If you talk with a student in Germany, which I have, they will tell you, in detail, about their history, legal system, culture, and politics. Upper grade students will also tell you a great deal about the American system of government — much more than the average urban black or Hispanic students can.

To summarize — the children in our K-12 urban public school system, for the most part, believe the following:

a) Republicans care about only the rich — the top 1% — and don't care about anyone else.

b) Republicans hate people of color and especially Latinos.

c) Republicans hate gays.

d) Republicans are racist. Many do not know that it was the Republicans under the leadership or Abraham Lincoln who emancipated the slaves and Republicans who advanced the civil rights legislation of the 1960s while the Democrat party led by Al Gore senior, Richard Byrd, and J. William Fulbright who attempted to block it.

e) It is the government that provides jobs. When asked that question many times in classrooms or assemblies — "who is it that creates jobs in America?" The answer is invariably, without hesitation, "the government." This is what they learn from their teachers and parents.

f) Corporations are bad, and profits are very bad. Business shouldn't make profits; they should give any excess money they make to their employees.

g) Taxes are good; they provide the money for the government to take care of people.

h) Government should expand and take care of everyone in the country.

i) America, rather than being a force for good in the world, has been a force for evil.

j) Government has an unlimited source of funds. (When asked "where is the government going to get the money to do all these things you want it to do?," the answer is "taxes.")

These children will soon be voters. How is it, in America, that we are raising children to believe that bigger government is better, that government is the engine that provides jobs, that profits are bad, that Republicans care about only the rich, that we are racist, and that we hate minorities and gays.

This is not something to be ignored. Our country is being changed forever by children who have had this type of indoctrination. We must figure out how to stop it. We need to create a love of country in our children as we once did. We need to have our children say the Pledge of Allegiance to the flag every morning or the Preamble to the Constitution (in English), as we once did. We need to teach our children that America has been a force for good in the world. We need to teach them that it is not the role of government to "take care" of people. We need to teach civics once again, and the Constitution. And above all we must stop this culture destroying policy of bi-lingual education. English should not be a second language, but the language of this Republic.

Until this problem is dealt with, and it needs to be soon, we will be raising generations of children who believe in an ever-larger government and who will permanently change America into Greece. There will be no Republican Party or conservative candidates who will win elections as more and more of the population is indoctrinated with leftist thinking. Goodbye to the Home of the Brave and the Land of the Free if we don't act on this issue.

If you look at the county by county map of how this nation voted in this last presidential election you will see how the Democrats dominated the urban population centers while the rest of the nation voted Republican. In State after State and district after district, Democrats won by promising that government would do something for the people hearing their message. Subsidize their healthcare, pay for their prescriptions, finance their schooling, guarantee their retirement… the list goes on and on. It’s the 21st century version of promising a chicken in every pot.

And, folks, let’s face it. It worked. What happens when a majority of voters are told they can vote themselves largesse from the public treasury, if they’ll only put the “right people” in charge?

We saw the answer Tuesday. They’ll stand in line for hours to vote to keep the goodies coming.

It’s going to be awfully hard to outwork, outspend and outvote them. The silent majority is being replaced by a “gimme” society. What’s going to prevent them from dragging this country over a fiscal cliff — and us along with them?

I don’t know. Do you?

Sorry to sound so pessimistic, but I’m stunned and saddened over the results of Tuesday’s elections. I thought it was one of the clearest choices between two different directions for this country I’ve ever seen. And I’m scared to death of the decision a majority of voters just made.

Ah, well, there is one positive thing I can say about the outcome. It will give this humble scribe — and the other conservative and libertarian writers — plenty to write about for the next few years.
